Long Road Ahead Of LGBTQ Community

India recently saw a victory of law and love. The five bench Supreme Court unanimously passed an order on IPC Section 377, making the country really free for everyone – including LGBTQ for the first time since 1861. The issue of Section 377 was first raised by NGO Naaz Foundation, which had in 2001 approached the Delhi High Court which had decriminalised sex between consenting adults of the same gender by holding the penal provision as "illegal". Moral policing often does not have a relationship with what law says or what the reality is. Changing such thought processes is an uphill task and can be achieved if it is tackled on some fronts: increase solidarity and educate masses. India is a vast and diverse country and attitudes towards this subject and experiences of LGBTI individuals vary vastly. The disparity between urban and rural India, language, caste, class and gender add further complexities to understanding this topic more fully.

Section 377 is a law that was formulated and brought to action in colonial India during the period of British Raj. There has always been serious discrimination against the LGBTQ community and allegations on how they are against nature’s law were floated to make this discussion tabooed. There are instances from the Hindu mythology and scriptures on the LGBTQ practices being a part of the culture but at this modern era the people from this community are facing moral policing issues. These are the effects are false propaganda and the landmark Delhi High Court judgement has given a license for this community who were pressurised for ages. But the overall mentality of the people should change to allow inclusivity and accept the fact that this state is perfectly normal.

The 6th of September, 2018, probably the day when each and every Indian realized true freedom. The freedom to be who you are and express yourself. It was the day when the nation witnessed the diluting of the infamous Section 377. It was a landmark judgement which caused ripples all across the country as it legalized gay sex.  Coming out as a part of this community is not only about sexual preferences but also reflects the right to choose one’s identity and preferences. Everyone is entitled to practice what they believe but it should not cross others’ boundaries and be enforced upon them.
