Dilution Of Section 377
On this day I would like to voice my opinion on dilution of section 377 of the Indian constitution by Delhi high court. It is one of the most dividing yet revolutionary judgements delivered by Delhi high court and I believe it has been long overdue. Most of the laws in our Indian constitution have been adapted from old colonial British Raj and even British have decriminalised homosexuality. This judgement will bring India into the modern era. I believe anything happening between two consenting adults shouldn't be of anyone's concern. Though the section has been diluted there are still lot more laws in Indian constitution which are sexist and treat women as inferior and needs to be protected, those laws should also be changed to more gender-neutral way to move into modern times. Though the laws are changing there is still a lot to do to change the perspective of society and people towards the LGBTQ+ community. I believe we are still in the infant stage in India when it comes to gender parity and non-discrimination of the LGBTQ+ community. I hope with this section scrapped there will be a lot more opportunities open to LGBTQ+ community to fight for their rights in the court of law. There is still a lot more to do and I wish to be part of the new movement.
THE ONLY OPINION THAT MATTERS – A HETEROSEXUAL MALES
While the British, during their unceremonious exit in 1947, took with them as much as they could carry and slightly more, they were kind enough, however, to leave behind a few trinkets we’ve cherished up until recently. One of those was the Indian rendition of the British hit, The Buggery act of 1533. And like a Sitar instrumental cover of a Coldplay song this too has weighed heavily on Indian society for all the wrong reasons. The difference being the former remained relevant for 100s of years. The latter probably won’t. Thank god for small mercies.
WED-20 By Envision Cell Celebrating "WORLD ENTREPRENEURS' DAY" At IIM Bodh Gaya.
“Every year, August 21 is calendar marked as the World Entrepreneurs’ Day. The purpose of the World Entrepreneurs’ Day is to create awareness for entrepreneurship, innovation and leadership throughout the world. This is the perfect day to celebrate the people who venture out into the business world with their own ideas and endeavours. WED is the day of founders, managers, producers, contractors, industrialists, innovators, administrators, designers and producers and last but the not least it is the day of management students around the world who carry the spark of entrepreneurship within them. Our objective to organize WED’20 just as we did last year albeit the virtual platform is to inculcate this very spark in our students here at IIM Bodhgaya as well.
Dilution Of Article 377, Will We See A New Indian Outlook?
Article 377, was a law drafted during the 19th century British rule, which in broad terms, covered a wide range of "Unnatural Sexual activities". Apart from non consensual sex and sex involving minors, the law also outlawed homosexual sex, or sex between individuals of the same gender. Even after India gained its independence in 1947, the law was upheld for decades. In the recent few years, there were many attempts to challenge the law, including challenging of High court verdicts in the Supreme Court, and raising of motions in Parliament to replace the law (aspects covering homosexuality) and decriminalise Homosexuality. However there was a united opposition across many parties including the ruling party, and the motion was defeated. In 2018, in a landmark verdict, the Supreme Court declared that the use of the law to victimise LGBTQ persons was not only unconstitutional, but also violated the basics rules of individual freedom. The sections including consensual same gender sex was decriminalised.
Scrapping Of Section 377 - A Step In The Right Direction
It is heart-warming to know there are those who are understanding towards people who have been declared guilty because they are different. They were not given a chance to fairly express their opinions and their perspectives. I feel proud that my county in no longer adhering to backward traditions.
